SaleTrek Terms of Service
Effective date: November 7, 2026
IMPORTANT, PLEASE READ: These Terms include a binding arbitration agreement and a class action waiver (see "Disputes and arbitration"), which means most disputes with us must be resolved individually by an arbitrator, not in court or by a jury. You can opt out within 30 days. These Terms also limit our liability, disclaim warranties, and include a release of claims about other users. SaleTrek is only a venue: we are not part of any sale, and you meet, buy, and sell at your own risk.
These Terms of Service ("Terms") are an agreement between you and Weathered Industries LLC ("Weathered Industries LLC", "we", "us"), the publisher of the SaleTrek app and related services (the "Service"). By creating an account or using SaleTrek, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the app.
Note: Weathered Industries LLC is being formed in Illinois; the legal entity name shown here may change, and we will update this document if it does.
Who can use SaleTrek
You must be at least 18 years old and able to form a binding contract to create an account, post sales, or use the Marketplace. You may not use SaleTrek if we have previously suspended or banned you, or if the law forbids you from using it. You are responsible for keeping your password secure and for all activity on your account. Give accurate information and keep it up to date.
SaleTrek is only a venue
SaleTrek helps people find, post, and plan visits to garage, yard, barn, estate, and similar sales, organize Community Sale Days, and list individual items on the Marketplace. We are only a platform that lets users connect.
- We are not a buyer, seller, auctioneer, broker, agent, or party to any sale, offer, or deal between users, and we never take possession of or title to any item.
- We do not handle or hold payments between users.
- We do not screen, verify, or do background checks on users, and we do not inspect, verify, or guarantee any item, sale, listing, address, event, price, or user, including their identity, honesty, quality, safety, or legality.
- Any deal is solely between the buyer and seller. We have no control over and no responsibility for whether a deal happens, the items, or anyone's conduct, online or offline.
Your responsibility for your sales and listings
You alone are responsible for your sales, listings, and items, including:
- Following all laws that apply to you, such as local permits, sign and parking rules, HOA rules, sales tax and income tax, and consumer and product safety laws.
- Checking that items are not recalled (see cpsc.gov/recalls) and are legal to sell where you are.
- Describing items honestly, including condition and defects, and removing listings once sold or no longer available.
- The safety of your property and anyone who visits it.
Prohibited items
Don't list, offer, or sell:
- Firearms, ammunition, gun parts or accessories, explosives, fireworks, or other weapons.
- Illegal drugs, drug paraphernalia, prescription or over-the-counter medications, marijuana or CBD products, alcohol, tobacco, or vaping products.
- Live animals.
- Items subject to a safety recall, including recalled children's products, cribs, and car seats, or children's products that don't meet current safety standards.
- Hazardous materials, such as fuel, chemicals, pesticides, or items containing them.
- Counterfeit, pirated, or stolen goods, or anything you don't have the right to sell.
- Adult content, sexual services, or any services that are illegal.
- Personal or financial information, government IDs, documents, or tickets you can't legally resell.
- Anything else illegal to sell or advertise where you or the buyer are.
We may update this list at any time, and we may remove any listing we think is unsafe or inappropriate, even if it isn't on this list.
Prohibited conduct
Don't:
- Post false, misleading, or spam listings, or listings that aren't real sales or items.
- List an address you aren't authorized to use, or post someone else's personal information.
- Harass, threaten, scam, defraud, stalk, or discriminate against anyone.
- Make fake offers, repeatedly fail to show up, or use offers or chat to move people off SaleTrek to scam them.
- Misuse the app, including scraping, reverse engineering, interfering with its security or operation, or creating accounts by automated means.
- Use SaleTrek to break any law or regulation.
Meeting people and safety
Garage sales and Marketplace pickups involve meeting strangers in person. All visits, meetups, pickups, and payments are at your own risk. We don't attend, supervise, or insure them. Use common sense:
- Meet in a safe, public, well-lit place when you can (many police stations offer safe exchange zones), go in daylight, and bring someone with you.
- Don't let strangers into your home, keep valuables secure, and don't share more personal information than needed.
- Inspect items before paying. Use cash or a payment method you trust, and watch out for overpayment, fake payment, and "shipping" scams. SaleTrek items are local pickup only.
- If you feel unsafe, leave and call 911 in an emergency.
- Drive safely and don't use the app while driving. Follow traffic and parking laws. Routes, distances, and times are estimates and may be wrong.
Marketplace
The Marketplace lets you list individual items, including free items, for local pickup only. It works on offers, not open chat:
- Before a price is agreed, a buyer can only make a price offer or accept the listed price. The seller can accept, decline, or counter with a new price. The buyer can accept a counter, make a new offer, or withdraw.
- Free-text chat between buyer and seller opens only after a price is agreed, and is for arranging pickup.
- Once a price is agreed, the item shows as Pending. The seller can mark it Sold or reopen it. Either side can cancel an agreed deal.
- Payment happens in person, off the app. SaleTrek never handles money for Marketplace items.
- Offers and agreed prices are between the buyer and seller only, and SaleTrek does not enforce them.
- Listings show your town only, never your street address, and expire after 30 days unless you renew them.
- The Prohibited items and conduct rules above apply to the Marketplace.
Community Sale Days
An organizer can create a Community Sale Day, a group sale event, and sellers can join their sales to it. Organizers must describe the event accurately and are responsible for any permits or local rules for the event. Each seller remains responsible for their own sale. SaleTrek is not the organizer of community events, does not sponsor or endorse them, and is not responsible for them.
Reports, blocking, and moderation
You can report a garage sale, Marketplace listing, user, or chat message in the app. You can also block another user. Blocking hides that person's sales, listings, offers, and messages from you, and stops them from messaging you or making you an offer. You can unblock them from Profile > Blocked users. We do not tell the other person that you blocked them.
We filter offensive language in sale titles and descriptions, Marketplace listing titles and descriptions, chat messages, and display names. That filter does not catch everything.
We will review every report and take action within 24 hours of receiving it. Action may include removing or hiding the sale, listing, or message, banning the account, or dismissing the report when it does not break these Terms. We may review reported messages to keep the service safe. We may also remove or hide any content, and suspend or end any account, at any time and for any reason, with or without notice, including content or conduct we believe breaks these Terms or creates risk. A banned account cannot post sales, listings, messages, or offers.
Your content
You own the content you post (sale details, addresses, photos, listings, messages, and your profile). By posting it, you give Weathered Industries LLC a non-exclusive, worldwide, royalty-free, sublicensable (to our service providers) license to host, store, copy, display, resize, and distribute it in order to run, improve, and promote SaleTrek. This license ends when you delete the content or your account, except for copies in backups for a limited time, copies we must keep by law, or copies others already received (for example, a notification or a message).
You promise that you have all the rights needed to post your content, that it is accurate, and that it doesn't violate anyone's rights (including copyright, privacy, or publicity rights) or the law. We are not responsible for user content, and we don't endorse it.
Copyright complaints
If you believe content on SaleTrek infringes your copyright, email support.saletrek@gmail.com with: your contact information; a description of the copyrighted work; the location of the content in the app; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove the content and, in appropriate cases, end the accounts of repeat infringers. If your content was removed and you believe it was a mistake, you can send us a counter-notice with the information required by the Digital Millennium Copyright Act.
Paid boosts (in-app purchases)
You can buy optional one-time boosts for your sale (for example Featured, Top Spot, and a "starting soon" alert). Boosted sales are labeled "Sponsored". Current prices are shown in the app before you buy and may vary by country and change over time. Each seller's first Featured boost is free. Boosts apply only to the sale they were bought for and last only for that sale's dates.
- Boosts don't guarantee any number of views, visitors, or sales, and placement may rotate.
- Purchases are processed by Apple or Google under their terms. All purchases are final and non-refundable, except as required by law or by Apple's or Google's refund policies. Refund requests must go through Apple or Google.
- If we remove a sale or account for breaking these Terms, its boosts are not refunded.
Termination
You can stop using SaleTrek and delete your account at any time in Profile > Delete account. We may suspend or end your access, or remove content, at any time if we believe you violated these Terms or created risk or possible legal exposure, or if we discontinue the app. Sections that by their nature should survive (including content license for backups, release, disclaimers, limitation of liability, indemnity, disputes and arbitration, and governing law) survive termination.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LISTING, ITEM, USER, ADDRESS, MAP, ROUTE, DISTANCE, TIME, OR NOTIFICATION IS ACCURATE, SAFE, LEGAL, OR RELIABLE. WE MAKE NO WARRANTY ABOUT ANY ITEM BOUGHT, SOLD, OR GIVEN AWAY THROUGH THE SERVICE. YOU USE THE SERVICE, AND DEAL WITH OTHER USERS, AT YOUR OWN RISK.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WEATHERED INDUSTRIES LLC AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS (TOGETHER, THE "SALETREK PARTIES") WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, THEFT, OR OTHER LOSS ARISING FROM ANY SALE, ITEM, MEETUP, PICKUP, PAYMENT, OR CONTACT BETWEEN USERS OR WITH ANY THIRD PARTY, OR FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
THE SALETREK PARTIES' TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50. THESE LIMITS APPLY TO ALL THEORIES OF LIABILITY, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), AND STRICT LIABILITY, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Some places don't allow certain disclaimers or limits, such as for gross negligence, intentional misconduct, or death or personal injury caused by our negligence, so some of the above may not apply to you. In that case, our liability is limited to the fullest extent the law allows.
Release of claims about other users
Because we are not part of deals between users, if you have a dispute with another user or any third party, you release the SaleTrek Parties from all claims, demands, and damages of every kind, known and unknown, arising from or connected with that dispute, to the fullest extent the law allows.
If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." If you live elsewhere, you waive any similar law.
Indemnity
You agree to defend, indemnify, and hold harmless the SaleTrek Parties from any claims, losses, damages, liabilities, fines, and expenses (including reasonable attorneys' fees) arising from your content, your sales, listings, purchases, or meetups, your dealings with other users, or your violation of these Terms, the law, or anyone's rights. We may take over the defense of any matter at your expense, and you will cooperate with us.
Disputes and arbitration
Please read this section carefully. It affects your rights.
- Informal resolution first: before filing any claim, you agree to email support.saletrek@gmail.com with a description of the dispute and give us 60 days to try to resolve it informally. We will do the same for you.
- Binding arbitration: if we can't resolve it, you and Weathered Industries LLC agree that any dispute, claim, or controversy relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of in court. The Federal Arbitration Act governs this section. The arbitrator decides all issues, except that a court may decide questions about the class action waiver, the batch arbitration process, and whether this section can be enforced. Arbitration may be held by video, phone, or written submissions, or in the county where you live. Payment of filing and arbitrator fees follows the AAA's rules.
- Exceptions: either side may bring an individual claim in small claims court if it qualifies, and either side may ask a court for an injunction to stop infringement or misuse of intellectual property or of the Service.
- Class action and jury waiver: YOU AND WE AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. The arbitrator may not combine more than one person's claims, except as described below.
- Mass filings: if 25 or more similar arbitration demands are filed against us by or with the help of the same lawyers or group, they will be administered in batches of up to 25, one batch at a time, to the extent the AAA's rules allow, and you and we agree to cooperate in good faith on that process.
- 30-day opt-out: you can opt out of this arbitration agreement by emailing support.saletrek@gmail.com within 30 days after you first accept these Terms, with the subject "Arbitration Opt-Out" and your name and account email. Opting out doesn't affect the rest of these Terms.
- If the class action waiver is found unenforceable for a claim, that claim must be decided in court and not in arbitration. If any other part of this section is found unenforceable, the rest still applies.
Time limit to bring claims
To the extent the law allows, any claim relating to the Service or these Terms must be filed within one year after it arises, or it is permanently barred.
Governing law and venue
These Terms are governed by the laws of the State of Illinois, USA, and applicable U.S. federal law, without regard to conflict-of-law rules. For any dispute not subject to arbitration, you and we agree to the exclusive jurisdiction of the state and federal courts located in Illinois, unless the law where you live requires otherwise.
Apple App Store
If you downloaded SaleTrek from the Apple App Store:
- These Terms are between you and Weathered Industries LLC only, not Apple. Weathered Industries LLC, not Apple, is solely responsible for the app and its content.
- Your license to use the app is limited to a non-transferable license on Apple-branded devices you own or control, as allowed by the App Store's Usage Rules.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for the app.
- Weathered Industries LLC, not Apple, is responsible for any claims by you or others relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, and intellectual property infringement claims.
- You confirm that you are not located in a country subject to a U.S. government embargo or listed as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play
If you downloaded SaleTrek from Google Play, these Terms are between you and Weathered Industries LLC, not Google, which is not responsible for the app. Your use must also follow the Google Play Terms of Service, and purchases are subject to Google Play's policies.
Third-party services
SaleTrek uses and links to third-party services (such as maps, routing, address search, app stores, and payment processing). We don't control and aren't responsible for them, and your use of them is subject to their own terms.
Changes
We may update these Terms. We will change the effective date above and, for significant changes, notify you in the app or by email. Continuing to use SaleTrek after a change means you accept the new Terms. Changes to the arbitration section won't apply to disputes that we already knew about before the change.
General
- Severability: if any part of these Terms is unenforceable, it will be limited to the minimum extent needed, and the rest stays in effect.
- No waiver: our failure to enforce a term isn't a waiver of it.
- Assignment: you may not transfer these Terms or your account. We may transfer them, including as part of a merger, acquisition, or sale of assets.
- Force majeure: we aren't responsible for delays or failures caused by events outside our reasonable control, such as outages, natural disasters, or provider failures.
- No relationship: nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
- Entire agreement: these Terms and the Privacy Policy are the whole agreement between you and us about SaleTrek, and replace any earlier ones.
- Notices: we may send notices in the app or to your account email. Send notices to us at support.saletrek@gmail.com.
